Cheer Match Media LLC ("Cheer Match," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you use the CheerMatch Allstar Gym Capture application, the CheerMatch website, and authorized branded, co-branded, or white-label versions of the application (collectively, the "Services").

The Services include authorized branded versions of the CheerMatch platform made available for organizations such as Varsity and other competition organizations or partners.

By using the Services, you acknowledge the practices described in this Privacy Policy.

1. INFORMATION WE COLLECT

Depending on how you use the Services, we may collect the following categories of information.

Account and Contact Information

When an account is created or used, we may collect information such as:

  • name;

  • email address;

  • gym, team, or organization;

  • account credentials or authentication information;

  • role or relationship to a participating organization; and

  • information necessary to administer your account.

Competition Information

We may collect information associated with participation in a virtual competition, including:

  • gym or organization name;

  • team name;

  • division or competition category;

  • event information;

  • submission information;

  • submission date and time;

  • competition identifiers; and

  • results or other competition-related records.

Video and Submitted Content

The primary purpose of the Capture App is to allow authorized users to record and upload video of cheerleading performances for virtual competition.

Accordingly, we may collect, transmit, store, and process videos submitted through the Services.

These videos may contain images, voices, likenesses, uniforms, team information, and performances of participating athletes, including athletes under the age of 18.

We process submitted videos for purposes related to operating and administering the applicable competition and Services.

Device and Technical Information

We may automatically collect certain technical information when the Services are used, including:

  • device type;

  • operating system and version;

  • application version;

  • IP address;

  • device or application identifiers;

  • date and time of access;

  • crash and diagnostic information;

  • network information; and

  • information concerning application performance.

We use this information primarily for security, troubleshooting, reliability, analytics, and improvement of the Services.

Camera and Media Access

The Capture App may request access to the device's camera, microphone, photo library, or media storage where necessary to record, select, review, and upload competition videos.

Such permissions are used to provide the functionality requested by the User.

Users may manage device permissions through their device settings.

2. HOW WE USE INFORMATION

We may use information collected through the Services to:

  • provide and operate the Capture App;

  • authenticate and manage accounts;

  • record and receive competition submissions;

  • associate submissions with the appropriate gym, team, division, event, or competition;

  • make submitted videos available to authorized competition personnel or judges;

  • administer virtual competitions;

  • communicate competition information and results;

  • provide technical and customer support;

  • troubleshoot application problems;

  • maintain the security and integrity of the Services;

  • detect unauthorized or fraudulent use;

  • maintain appropriate competition and submission records;

  • improve the reliability and functionality of the Services;

  • comply with applicable legal obligations; and

  • enforce our Terms of Use and competition requirements.

Cheer Match does not currently use artificial intelligence to judge, score, or analyze competition videos submitted through the Capture App.

3. CHILDREN AND MINORS

Cheer Match recognizes that cheerleading competitions frequently involve athletes under the age of 18.

The Capture App is intended primarily for use by authorized adults and organizational representatives, such as coaches, gym owners, administrators, competition personnel, and other authorized users.

The Capture App is not intended to enable children to independently create accounts or submit personal information without appropriate authorization.

Videos Containing Minors

Competition videos submitted through the Services may contain recordings of minors.

Cheer Match relies on the submitting gym, coach, team, competition organization, or other authorized representative to obtain any parental or guardian permissions, releases, or consents required to record and submit participating athletes.

Users should not upload a video containing a minor unless they are authorized to do so and the appropriate permissions have been obtained.

If we learn that personal information from a child has been collected in a manner inconsistent with applicable law or without required authorization, we will take reasonable steps to address the situation, which may include deleting the information.

Parents or legal guardians who believe information concerning their child has been submitted improperly may contact us at support@cheermatch.com.

4. HOW WE SHARE INFORMATION

We do not sell competition videos or personal information.

We may disclose information in the circumstances described below.

Competition Organizations and Authorized Personnel

Information and submitted videos may be shared with authorized individuals and organizations involved in administering the applicable competition, including:

  • judges;

  • competition administrators;

  • event producers;

  • participating organizations where appropriate; and

  • authorized platform or branded-application partners.

Access is provided as reasonably necessary to administer the competition or provide the Services.

Branded Applications and Partners

Cheer Match may provide branded or co-branded versions of the Capture App for third-party organizations, including organizations such as Varsity.

When you participate in a competition or use a branded version of the Application, certain information may be shared with the organization responsible for that competition or branded experience.

Where required, additional disclosures regarding that organization's handling of information may be provided at the time information is collected.

Service Providers

We may use third-party service providers to perform functions such as:

  • cloud hosting;

  • video storage and delivery;

  • application infrastructure;

  • authentication;

  • security;

  • analytics;

  • crash reporting;

  • email communications; and

  • technical support.

These providers may process information on our behalf as necessary to perform their services.

Legal and Safety Requirements

We may disclose information when we reasonably believe disclosure is necessary to:

  • comply with applicable law, regulation, subpoena, court order, or legal process;

  • protect the rights or property of Cheer Match;

  • investigate fraud, misuse, or security incidents;

  • enforce our agreements; or

  • protect the safety and security of users or others.

Business Transactions

If Cheer Match Media LLC is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, information may be transferred as part of that transaction, subject to applicable law.

5. WE DO NOT SELL PERSONAL INFORMATION

Cheer Match does not sell personal information or submitted competition videos for monetary compensation.

We do not sell athlete information to advertisers.

We do not sell competition videos to data brokers.

6. ADVERTISING AND TRACKING

The Capture App is designed primarily to facilitate competition participation and video submission.

Cheer Match does not use submitted competition videos for behavioral advertising.

If our use of advertising, analytics, tracking technologies, or third-party advertising services materially changes, this Privacy Policy and any required application disclosures will be updated accordingly.

7. VIDEO USE

Submitted competition videos are used primarily for purposes associated with the applicable competition and operation of the Services.

This may include:

  • receiving and validating a submission;

  • providing the submission to authorized judges or competition personnel;

  • administering the competition;

  • resolving questions or disputes concerning a submission;

  • providing technical support; and

  • maintaining appropriate competition records.

Submitting a video through the Capture App does not, by itself, authorize Cheer Match to use an athlete's image or likeness for unrelated advertising or promotional campaigns.

Separate authorization may be obtained where promotional use is desired.

8. DATA RETENTION

We retain information for as long as reasonably necessary to provide the Services, administer competitions, satisfy contractual obligations, maintain appropriate records, resolve disputes, enforce agreements, and comply with applicable law.

Competition videos may be retained for a period following completion of an event for competition administration, verification, dispute resolution, recordkeeping, or other legitimate operational purposes.

When information is no longer reasonably required, we may delete or anonymize it in accordance with our data-retention practices and applicable law.

9. DATA SECURITY

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information and Submitted Content against unauthorized access, disclosure, alteration, loss, or misuse.

However, no electronic transmission, storage system, network, or online service can be guaranteed to be completely secure.

Users are responsible for maintaining the confidentiality and security of their account credentials.

10. YOUR PRIVACY CHOICES AND RIGHTS

Depending on where you live, you may have certain rights concerning your personal information.

These rights may include the ability to request:

  • access to personal information we maintain about you;

  • correction of inaccurate information;

  • deletion of certain personal information;

  • information about how personal information is used or disclosed; and

  • other rights provided by applicable privacy law.

We may need to verify your identity or authority before fulfilling a request.

Where a request concerns an athlete or minor whose information was submitted by a gym, team, or competition organization, we may need to coordinate with that organization to verify the request and determine the appropriate response.

11. DELETION REQUESTS

Users may request deletion of their account or personal information by contacting support@cheermatch.com or by using account-deletion functionality provided within the Application, where available.

Certain information may be retained when reasonably necessary or legally permitted for purposes such as competition integrity, dispute resolution, fraud prevention, legal compliance, or establishment and defense of legal claims.

Parents or legal guardians may contact us regarding personal information concerning their minor child.

12. THIRD-PARTY LINKS AND SERVICES

The Services may contain links to or integrations with third-party websites, applications, or services.

Those third parties may maintain their own privacy policies and practices. Cheer Match is not responsible for the privacy practices of third parties except to the extent required by applicable law.

Users should review the applicable privacy policies of third-party services they use.

13. INTERNATIONAL USERS

The Services may be accessed from locations outside the United States.

Information may be processed and stored in the United States or other jurisdictions in which Cheer Match or its service providers operate.

Where required, we will take appropriate measures regarding international transfers of personal information.

14. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy periodically to reflect changes to the Services, technology, business practices, partnerships, or applicable laws.

When we make material changes, we will update the effective date and provide additional notice when required by applicable law.

15. APPLE APP STORE PRIVACY

When the Application is distributed through the Apple App Store, Apple may independently collect information related to downloads, device usage, purchases, diagnostics, or other interactions with Apple's services.

Apple's collection and use of that information is governed by Apple's own privacy policies and terms.

Cheer Match is responsible for accurately describing the data collected through the Application in applicable App Store privacy disclosures.

16. BRANDED VERSIONS OF THE APPLICATION

This Privacy Policy applies to the CheerMatch Allstar Gym Capture App and authorized branded, co-branded, or white-label instances powered by the CheerMatch platform unless a different privacy policy is expressly presented for a particular application or service.

A branded application may identify the applicable competition organization or partner and may provide additional privacy disclosures regarding information shared with that organization.
